Oshana regional councillor for the Ongwediva Constituency, Andreas Uutoni on Tuesday appeared in the Oshakati Magistrate’s Court for allegedly refusing to comply with police instructions. Uutoni is accused of crashing his Toyota pick-up into two head of cattle near Onyelelo village on the Oshakati-Omungwelume road on Sunday. He allegedly refused the breathalyser test and has been in police custody at Oshakati since Sunday. During his court appearance on Tuesday, public prosecutor Pallhus Shuudeni suggested that Uutoni be granted bail of N$2 000. Magistrate Antonious Shapumba then released him on N$1 000 bail after the accused said he could not afford the N$2 000 bail. It was not immediately known if Uutoni was indeed taken to the hospital to be tested for driving under the influence of alcohol or not. He indicated to the court that he will conduct his own defence during his hearing and his case was postponed to 20 April for further police investigations. In the same court on Tuesday, the magistrate cautioned and discharged two learners from Iiipumbu Senior Secondary School who faced common assault charges after allegedly beating up a fellow learner on the school grounds last Friday. Shuudeni recommended that the two Grade 12 learners, 20-year-old Matheus Melola, and Elikana Shivolo 19, be fined N$600 or sentenced to two months imprisonment, suspended for three years provided they are not found guilty of common assault during the suspension period. The offence committed by the two learners, Shuudeni said, is not that serious and as such, they deserved a suspended sentence to be able to go back to school and continue with their education. “As learners, they have no income of their own and the money will come from the pockets of their parents,” Shapumba explained while handing down the suspended sentence to Melola and Shivolo. -NAMPA
