Justice Minister Yvonne Dausab says publication of the regulations by presidential proclamation is a constitutional requirement in accordance with Article 26(5) of the Namibian Constitution. Dausab also pointed out that people can only comply with something they see so publication and distribution is important to ensure compliance. The publication of the regulations by proclamation also gives it the force of law and allows for punishment in the event of non-compliance. Dausab said regulations, also once published, provides information pertaining to what is required and provides scope for definitions of important words like restricted area, lockdown, authorised officers and the head of an institution for instance. She said the need to gazette is to ensure the public who are expected to comply know what the dos and don’ts are and it provides the scope of performance for the law enforcement agents. She also pointed out that the regulations were unfortunately not published in the Government Gazette at midnight as was initially announced but the effective date still remains 28 March for the start and the end remains at 17 April 2020. Dausab reminded Namibians that this is an extraordinary situation that requires understanding and cooperation from all and calls on Namibians to adhere to the regulations, stay safe so the virus is contained. Dausab said the wellbeing, health and safety of the Namibian people is supreme.
