Judgement in the appeal hearing of Ricardo Gustavo’s bail application is set for 28 July. Lawyer Luis Botha, representing Fishrot accused, Gustavo, argued that the accused person is not a flight risk and that he will hand in his travel documents. He further said that at no point has the appellant proved to interfere in the investigations and that he will not leave the Windhoek municipal area without authorisation as well as report twice daily to the investigating officer of the Anti-Corruption Commission (ACC). Giving him bail, Botha argues, will provide Gustavo with a chance to look after his family. But prosecutor Cliff Lutibezi warned that it might prove risky to grant the appellant bail, who he said is part of a syndicate. Botha argued that denying bail to an accused while the court knows that he will not interfere with the justice system is unconstitutional and making a mockery of the criminal justice system.
