Former Fisheries Minister Bernhard Esau, former Minister of Justice, Sacky Shanghala alongside eight others who were arrested in connection with the alleged Fishrot corruption scandal last year have not indicated an intention to apply for bail yet. This was confirmed by the Judiciary spokesperson Ockert Jansen. The 10 will, however, appear in absentia in the Windhoek Magistrate’s Court on Thursday. Their appearance is just a normal scheduled check on the progress of investigations and to possibly set a date for plea and trial. The case could be postponed to later in May, following the institution of the COVID-19 State of Emergency. It remains unclear why the 10 are delaying their bail application. Speculation is that they are waiting for the High Court judgement, in an application of two senior South African lawyers, who were found guilty and fined after admitting not having work permits to represent the initial Fishrot six. They have asked the court to set aside their convictions and sentences, and declare it null and void. This judgement will be delivered on Monday. Senior counsel Mike Hellens and Dawie Joubert were charged, convicted and sentenced under the Immigration Control Act. The lawyers now claim that they were unlawfully arrested and detained in November. They also allege they admitted guilt for fear of being detained for an extended period in a Namibian jail.
