The Windhoek High Court says two people who have urgently applied to stop the upcoming SWAPO Party Extra-Ordinary Congress should have notified all parties, who would be affected by the order. Judge Thomas Masuku ruled in favour of that view, but stressed that he is not inclined to dismiss the case as yet. This came after defence lawyer Tembeka Ngcukaitobi, appearing for SWAPO and Secretary-General, said failure to join a host of people said to have not been at last year’s congress should have been informed of the application. He said failing to notify these people, who include governors, constituency councillors, members of the party’s women and elders’ councils and the youth league amounts to denying them their right to be heard. The lawyer, instructed by Conradie and Damaseb, said the two members cannot elevate their rights above those of others. Applicants, Mirjam Shiitala and Griffiths Madonsela, countered that serving the Secretary-General and the party was sufficient. He said Secretary-General Shaningwa was served as the person who has called the upcoming extraordinary congress set for this Thursday to Sunday. Arguments for urgency will start when the urgent case resumes Tuesday afternoon.
