The SWAPO extraordinary congress will proceed as planned after the Windhoek High Court allowed the withdrawal of a case to stop it Tuesday afternoon. Judge Thomas Masuku allowed applicants Mirjam Shiitula and Selma Namboga to withdraw their urgent case, and apply for inclusion of all interested parties in the case. Judge Masuku postponed the remaining case, which urgently challenges the sixth ordinary congress held last year. Judge Masuku will further determine at December’s hearing, if cost for Tuesday’s case should be paid before the remaining challenge is heard next year. His ruling followed concessions by Shiitula and Namboga’s lawyer, Advocate Griffiths Madonsela to issue the new orders. Madonsela said the court’s finding in favour of notifying all interested parties had left the applicants with little information on how they should persist with their application. He said the applicants did not know why the court ruled in favour of notifying all interested people, which has made it difficult for them to proceed.
